Terms & Conditions

R Drummond & Son – Terms & Conditions of Service
Effective date: 10 November 2024

1. General
1.1 These Terms and Conditions (“T&Cs”) apply to all quotations, bookings, and works carried out by R Drummond & Son, based at 17 Monks Court, North Road, Lancing, West Sussex BN15 9BD.
1.2 By accepting a quotation or engaging our services, the Customer agrees to be bound by these T&Cs.
1.3 No verbal or written variation to these T&Cs shall be binding unless confirmed in writing by R Drummond & Son.

2. Quotations
2.1 All quotations are free and valid for 30 days from the date issued unless otherwise stated.
2.2 Quotations are based on the information provided by the Customer at the time of assessment. Any changes to the scope of works may result in a revised quotation.
2.3 VAT is included/excluded as stated on the quotation (if applicable).

3. Deposits and Booking Confirmation
3.1 A deposit is required to secure a booking and confirm a start date.
3.2 No date will be held or work scheduled until the required deposit has been received in cleared funds.
3.3 Deposits are typically 10–25 % of the total quotation value unless otherwise stated in writing.
3.4 Deposits are non-refundable if the Customer cancels the job within 7 days of the agreed start date, except where R Drummond & Son cancels or reschedules.
3.5 Once a deposit has been received, the Customer will be provided with a confirmed start date in writing (email or text confirmation).

4. Payment Terms
4.1 The balance payment is due immediately upon completion of the works unless otherwise agreed in writing.
4.2 Payment may be made by bank transfer, debit/credit card, or cash (with receipt).
4.3 R Drummond & Son reserves the right to charge interest on overdue invoices at 4 % above the Bank of England base rate, accruing daily until payment is made in full.

5. Scheduling and Delays
5.1 While every effort is made to maintain agreed start and completion dates, unforeseen circumstances such as adverse weather, material delays, or illness may cause unavoidable changes.
5.2 The Customer will be notified promptly of any necessary rescheduling.
5.3 The Customer agrees to provide clear access to the property during agreed working hours.

6. Customer Responsibilities
6.1 The Customer must ensure that areas to be decorated are clear of furniture and personal belongings unless prior arrangements are made.
6.2 The Customer must ensure access to electricity, water, and toilet facilities during the works.
6.3 The Customer is responsible for providing accurate information regarding colours, finishes, and specifications.

7. Materials and Workmanship
7.1 All materials remain the property of R Drummond & Son until paid for in full.
7.2 We use trade-quality materials and apply them in accordance with the manufacturer’s recommendations.
7.3 All work is carried out with reasonable care, skill, and attention to achieve a professional finish.

8. Cancellations and Refunds
8.1 If the Customer wishes to cancel or postpone work after paying a deposit, they must notify us in writing.
8.2 Cancellations made more than 7 days before the start date will receive a refund minus any non-recoverable costs (e.g. ordered materials).
8.3 Cancellations within 7 days of the start date will forfeit the deposit.

9. Liability
9.1 R Drummond & Son shall not be liable for damage to property or delays caused by factors beyond our control (e.g. damp, structural issues, adverse weather).
9.2 We hold full Public Liability Insurance; details are available upon request.
9.3 Nothing in these T&Cs limits our liability for death or personal injury caused by our negligence.

10. Complaints
10.1 Any concerns should be raised directly with the business owner within 7 days of completion so they can be resolved promptly and professionally.
10.2 We aim to resolve all complaints amicably within 14 days.

11. Governing Law
11.1 These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
11.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
